Please read these Terms and Conditions ("Terms") carefully before using the HDQGen desktop application (the "App") or our website at hdqgen.com (the "Site"). These Terms form an agreement between you ("you" or "user") and HDQGen ("we", "us", or "our").

By downloading, installing, or using the App, or by using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the App or the Site.

1. About HDQGen

HDQGen is a local AI desktop application that provides chat, image generation, image editing, video generation, music generation, a general purpose Agent, and a Coding Agent. The App is designed to run primarily on your own device, without requiring a constant connection to our servers.

2. License to Use the App

2.1 Grant of License

When you purchase HDQGen, we grant you a personal, non exclusive, non transferable license to install and use the App on your own devices, subject to these Terms.

2.2 One Time Payment

HDQGen is sold as a one time purchase. This means you pay once and you may continue using the version of the App you purchased without recurring subscription fees. Future major versions or additional products may be offered separately and may require a new purchase.

3.1 Payment Processing

Purchases of HDQGen are processed through Gumroad. By purchasing HDQGen, you also agree to Gumroad's own terms of service, which govern the payment transaction.

3.2 Pricing

The current price of HDQGen is listed on our website and on our Gumroad product pages. We reserve the right to change our pricing at any time. Price changes will not affect purchases already completed.

3.3 Refunds

Refund requests are handled in accordance with our refund policy and, where applicable, Gumroad's policies. Please contact us directly if you experience issues with the App so we can try to resolve them before a refund is requested.

4. Your Content

4.1 Ownership

You retain full ownership of any content you create using HDQGen, including chats, images, videos, music, and code. Since HDQGen processes your content locally on your device, we do not claim any rights to what you create.

4.2 Your Responsibility

You are solely responsible for the content you create, generate, or process using the App. You agree not to use HDQGen to create content that is illegal, infringes on the rights of others, or violates any applicable law.

5. AI Generated Content

5.1 No Guarantee of Accuracy

The App uses artificial intelligence to generate text, images, video, music, and code. AI generated content may sometimes be inaccurate, unexpected, or unsuitable for your intended purpose. We do not guarantee the accuracy, quality, or appropriateness of any AI generated output.

5.2 Review Before Use

You are responsible for reviewing and verifying any AI generated content before relying on it or distributing it, especially for professional, legal, medical, financial, or safety related purposes.

6. The Agent and Coding Agent

The App includes a general purpose Agent and a Coding Agent that can perform actions such as browsing the web, reading and writing files, running code, taking screenshots, and connecting to third party tools through MCP servers.

6.1 Permission Controls

The App is designed to require your permission before the Agent or Coding Agent performs certain actions. You are responsible for reviewing these permission requests carefully before approving them.

6.2 Third Party Tools

If you connect your own third party tools or MCP servers to the Agent, you are responsible for ensuring that such connections comply with the terms of those third party services. We are not responsible for the actions of third party tools you choose to connect.

6.3 Your Responsibility for Agent Actions

Because the Agent and Coding Agent can read, write, and execute files and code on your device, you are responsible for supervising their use and for any consequences resulting from actions you approve.

7. Intellectual Property

The App, including its design, logo, wordmark, and underlying software, is owned by HDQGen and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of the App itself to you. You receive only the license described in Section 2.

8. Disclaimer of Warranties

The App and Site are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non infringement. We do not warrant that the App will be error free, uninterrupted, or compatible with every device or configuration.

9. Limitation of Liability

To the fullest extent permitted by law, HDQGen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of use, arising out of or related to your use of the App or Site, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App.

10. System Requirements

HDQGen is designed to work on Windows and Linux. and is built to run on both CPU and GPU configurations. You are responsible for ensuring your device meets the requirements needed to run the App properly. We are not responsible for performance issues caused by incompatible or insufficient hardware.

11. Updates and Changes to the App

We may release updates, patches, or new versions of the App from time to time. Some updates may be provided free of charge, while significant new versions may be offered as a separate purchase. We are not obligated to provide ongoing updates or support.

12. Termination

We may suspend or terminate your license to use the App if you violate these Terms. Upon termination, you must stop using the App and delete any copies in your possession.

13. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will update the "Last Updated" date at the top of this page. Continued use of the App or Site after changes take effect means you accept the updated Terms.
